Alternative Dispute Resolution
Mediation
Mediation brings the parties together as a voluntary means of resolving a family issue. This is not a legally binding process, absent an agreement. If this process fails to reach an agreement – unless the process is declared “open” – the negotiations have no bearing on any legal proceeding.
Arbitration
A neutral, third-party Arbitrator acts an impartial judge, on hearing evidence in a formal manner.
Mediation-Arbitration
The Mediation-Arbitration process begins with Mediation. If parties are unable to form an agreement in Mediation, the Mediator then serves the parties as an independent Arbitrator who will make an award.
